Important: These Terms of Service constitute a legally binding agreement between you and MaltPOS Limited. Please read them carefully. By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
By accessing or using the MaltPOS platform, websites, mobile applications, or any services provided by MaltPOS Limited (hereinafter referred to as "MaltPOS," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations.
If you are using MaltPOS services on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms and that you are agreeing to these Terms on behalf of that entity.
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our Services. By using MaltPOS, you represent and warrant that you meet these eligibility requirements.
MaltPOS operates in Uganda, Kenya, Tanzania, and Rwanda. You agree to comply with all local laws, regulations, and tax requirements applicable to your use of our Services in your jurisdiction.
To access MaltPOS Services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to immediately notify MaltPOS of any unauthorized use of your account or any other breach of security. MaltPOS will not be liable for any loss or damage arising from your failure to comply with this security obligation.
MaltPOS reserves the right to verify the identity of any Customer and may request additional information or documentation to confirm the legitimacy of a business or account.
Security Best Practice
We recommend using strong, unique passwords for your MaltPOS account and enabling two-factor authentication when available. Never share your account credentials with unauthorized persons.
MaltPOS provides cloud-based point-of-sale and business management software designed specifically for East African markets. Our Services include but are not limited to: sales processing, inventory management, customer management, reporting and analytics, multi-location support, and integration with local payment methods.
While we strive to maintain 24/7 availability, MaltPOS does not guarantee uninterrupted access to the Services. We may perform scheduled maintenance and updates, which may temporarily affect service availability.
MaltPOS includes offline capabilities that allow basic operations during internet outages. Data entered offline will sync automatically when internet connectivity is restored. You are responsible for ensuring regular synchronization to prevent data loss.
MaltPOS reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will make reasonable efforts to notify Customers of significant changes that may affect their use of the Services.
MaltPOS Services are provided on a subscription basis. Fees are based on the plan selected and may vary by country. All fees are quoted and charged in the local currency of your country (UGX, KES, TZS, or RWF).
Subscription fees are billed in advance on a monthly or annual basis, depending on your selected billing cycle. Payment is due at the beginning of each billing period.
MaltPOS accepts payments through various local payment methods including mobile money (M-Pesa, Airtel Money, etc.), bank transfers, and credit/debit cards where available. You authorize MaltPOS to charge the selected payment method for all applicable fees.
New Customers may be eligible for a free trial period. At the end of the trial period, you will be automatically charged for the selected subscription plan unless you cancel before the trial ends.
MaltPOS reserves the right to change subscription fees with 30 days' notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.
All fees are exclusive of applicable taxes, including Value Added Tax (VAT) or other sales taxes as required by local laws in Uganda, Kenya, Tanzania, and Rwanda. You are responsible for paying all taxes associated with your subscription.
Local Payment Support
MaltPOS integrates with local payment providers across East Africa. Transaction fees from payment providers are separate from MaltPOS subscription fees and are governed by the terms of those providers.
You retain all rights, title, and interest in and to your Business Data. MaltPOS claims no ownership rights over your Business Data.
By using MaltPOS Services, you grant us a limited license to process, store, and transmit your Business Data as necessary to provide the Services and as described in our Privacy Policy.
MaltPOS implements industry-standard security measures to protect your Business Data. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
While MaltPOS performs regular backups of system data, you are responsible for maintaining your own backups of critical Business Data. MaltPOS is not liable for any data loss.
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
Upon termination of your account, MaltPOS will retain your Business Data for a limited period as specified in our Data Retention Policy to allow for account recovery. After this period, data may be permanently deleted.
The MaltPOS platform, software, trademarks, logos, and all content (excluding Customer Business Data) are the exclusive property of MaltPOS Limited and are protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, MaltPOS grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes during your subscription term.
You may not: (a) copy, modify, or create derivative works of the Services; (b) reverse engineer, decompile, or attempt to extract source code; (c) resell, sublicense, or commercially exploit the Services; (d) remove any proprietary notices; or (e) use the Services to build a competitive product.
Any feedback, suggestions, or ideas you provide regarding MaltPOS Services may be used by MaltPOS without obligation or compensation to you.
You agree not to use MaltPOS Services to:
You represent and warrant that your business operations comply with all applicable laws, including but not limited to tax laws, consumer protection laws, and industry-specific regulations in Uganda, Kenya, Tanzania, and Rwanda.
MaltPOS reserves the right to monitor use of the Services for compliance with these Terms. We may investigate violations and cooperate with law enforcement authorities.
You may terminate your subscription at any time through your account settings or by contacting customer support. Termination will be effective at the end of your current billing period. No refunds will be provided for partial months.
MaltPOS may suspend or terminate your access to the Services immediately if: (a) you violate these Terms; (b) you fail to pay fees when due; (c) required by law; or (d) we cease offering the Services in your jurisdiction.
Upon termination: (a) your right to use the Services ceases immediately; (b) you must pay any outstanding fees; (c) we will provide access to your Business Data for a limited period as described in our Data Retention Policy.
Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive termination of these Terms.
MaltPOS Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, MaltPOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from your use of the Services.
MaltPOS's total cumulative liability to you for all claims arising from or related to these Terms or the Services shall not exceed the total amount paid by you to MaltPOS in the six (6) months preceding the claim.
You agree to indemnify, defend, and hold harmless MaltPOS and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your business activities.
Important Limitations
MaltPOS is a software tool to assist with business operations. You remain responsible for your business decisions, financial reporting, tax compliance, and regulatory obligations. The Services do not constitute financial, legal, or tax advice.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law principles.
Any disputes arising from these Terms shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to mediation in Kampala, Uganda. If mediation is unsuccessful, disputes shall be resolved in the courts of Uganda.
While these Terms are governed by Ugandan law, you agree to comply with all applicable local laws and regulations in your country of operation (Uganda, Kenya, Tanzania, or Rwanda) regarding business operations, data protection, and consumer rights.
MaltPOS reserves the right to modify these Terms at any time. We will provide notice of material changes through the Services, by email, or by posting a notice on our website.
Your continued use of the Services after the effective date of modified Terms constitutes acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Services.
It is your responsibility to review these Terms periodically for changes. The "Last Updated" date at the top of these Terms indicates when they were last revised.

These Terms, together with our Privacy Policy and any other legal notices published by MaltPOS, constitute the entire agreement between you and MaltPOS regarding the Services and supersede all prior agreements and understandings.
By using MaltPOS Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
